Welcome to Homeschool Hero. These Terms of Service ("Terms") govern your use of our homeschool planning and compliance platform. By accessing or using Homeschool Hero, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our service.

1. Acceptance of Terms

By creating an account, accessing our website, or using any part of Homeschool Hero's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the service after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years old to create an account and use Homeschool Hero. By using this service, you represent and warrant that you are of legal age to form a binding contract.

Homeschool Hero is intended for use by parents and guardians for homeschool planning and compliance purposes. It is not designed for use by children.

3. Account Registration and Security

To use Homeschool Hero, you must create an account by providing accurate and complete information. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Service Plans and Billing

4.1 Free Tier

The Free tier provides access to basic features including unlimited students, unlimited provincial reports, activity tracking (90-day history), weekly planning (next 7 days), and access to guides and resources. Free tier is available at no cost indefinitely.

4.2 Hero Tier

The Hero tier is a paid subscription offering premium features including unlimited activity history, unlimited planning, email reminders, advanced analytics, and additional tools.

Pricing:

• Monthly: $12 CAD per month
• Annual: $120 CAD per year (equivalent to $10/month)

4.3 Billing and Payments

• All payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled
• You will be charged at the beginning of each billing period
• Prices are subject to change with 30 days notice
• All fees are non-refundable except as required by law
• Taxes may apply based on your location

4.4 Free Trial

We may offer a 14-day free trial of Hero tier. No credit card is required for the trial. After the trial period, you will be downgraded to the Free tier unless you subscribe to Hero tier.

4.5 Cancellation and Refunds

You may cancel your Hero tier subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to Hero features until the end of the paid period, then be downgraded to Free tier.

We do not offer refunds for partial months or unused portions of subscriptions, except as required by law or at our sole discretion.

5. Acceptable Use

You agree to use Homeschool Hero only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Scrape, spider, or harvest data from the service
• Impersonate another person or entity
• Share your account credentials with others
• Use the service to harass, abuse, or harm others
• Reverse engineer or attempt to extract source code
• Remove or modify any copyright or proprietary notices

We reserve the right to suspend or terminate accounts that violate these terms.

6. User Content and Data

6.1 Your Data

You retain all rights to the data you input into Homeschool Hero, including student information, activity logs, plans, and generated reports. We do not claim ownership of your content.

6.2 License to Us

By using our service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you. This license terminates when you delete your account.

6.3 Data Backup and Loss

While we implement regular backups, you are responsible for maintaining your own backups of important data. We are not liable for any data loss, and recommend Hero tier users regularly export their data.

7. Intellectual Property

Homeschool Hero and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our software or content
• Use our trademarks, logos, or branding without permission
• Create derivative works based on our service
• Frame or mirror any part of the service

8. Third-Party Services and Links

Homeschool Hero uses third-party services including Supabase (database), Resend (email), Stripe (payments), and Vercel (hosting). Your use of these services is subject to their respective terms and privacy policies.

We may include links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party sites is at your own risk.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of information

We do not warrant that:

• The service will meet your specific requirements
• The service will be available at all times
• Any errors will be corrected
• The service is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMESCHOOL HERO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Cost of substitute services
• Business interruption
• Any damages arising from your use or inability to use the service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Homeschool Hero and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or transmit through the service

12. Termination

You may terminate your account at any time by deleting it through your account settings or by contacting us. Upon termination:

• Your access to the service will cease immediately
• Your data will be deleted within 30 days
• Active Hero subscriptions will be cancelled (no refund for partial periods)

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Abuse or misuse the service

We will provide notice before termination when reasonably possible, except in cases of serious violations or legal requirements.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the service shall be resolved in the courts of Manitoba, Canada, and you consent to the exclusive jurisdiction of such courts.

14. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the service.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Homeschool Hero regarding the use of our service, superseding any prior agreements.
